CONDITIONS OF USE OF ZTALENT.TECH

1. Identification

The Company refers to ZTalent Gestión y Tecnología S.L., registered office at Calle López de Hoyos, 42, 28006 Madrid (Spain), VAT No. B72543317, registered with the Commercial Registry of Madrid, Volume 44,165, Folio 98, Book 0, Section 0, Page M-778817. It owns the website www.ztalent.tech ("ZTalent"), the use of which is subject to these Conditions of Use and Contracting and the other legal texts available on the site.

2. Acceptance

Access to and use of ZTalent.tech imply express acceptance of these Conditions of Use and Contracting, as well as the Privacy Policy in force at the time of access. Registering as a user and using the available services constitute a legally binding agreement between the user (SAP professional or company) and ZTalent.

Some services may be subject to specific terms or fees, which will be informed in advance. ZTalent may modify these conditions without prior notice; please review the current version periodically.

3. Purpose of the Platform

ZTalent.tech is a professional network specialized in SAP®, connecting companies and professionals through technology intermediation services. The platform offers features geared towards professional development: training, job opportunities, networking spaces, forums, blogs, and informative content.

ZTalent acts as a technology intermediary, facilitating user contact without intervening in any contractual agreements they may enter into.

4. Definitions

• User: any natural or legal person who accesses or uses ZTalent.
• Account: a profile linked to an email address and password.
• Registration: creating an account on ZTalent.
• Free Services: basic features at no cost, such as public searches and newsletters.
• Premium Services: credit packs, subscriptions, or advanced services (e.g., Zelenia and VIKO).
• Zelenia: an AI tool for job recommendations, profile improvement, and market analysis.
• Content: information posted by users (texts, images, videos, documents, job offers, profile data, etc.).
• Job offer: a specific task entrusted by a Company to an SAP Professional.
• Website: www.ztalent.tech and its digital extensions, including apps and social media.

5. Registration and Accounts

Registration requires truthful and up-to-date data. Users are responsible for keeping their credentials confidential. Personal data processing is governed by the Privacy Policy.

6. Services and Features

Including, among others: search and browsing, SAP® profile creation, internal messaging, statistics, VIKO service, and use of Zelenia.

• Search & Browsing: directory of SAP® professionals with filters by experience, certifications, and availability.
• Profiles & CVs: create, edit, and publish a profile; upload CVs, portfolios, and certificates.
• Messaging & Networking: internal chat (private or group), connection requests, and themed forums.
• Reports & Statistics: profile views, company interest, and sector trends.
• VIKO Service: remote access to preconfigured SAP instances for training, including practice environments with real data, technical support, and user administration; available hourly or in packs.
• Use of Zelenia (AI): optimizes job searches, suggests profile improvements, analyzes market trends; enables custom reports, automates selection processes, and provides proactive recommendations.

7. Publications, Blogs, Posts, Forum & Use of Zelenia

Purpose: to facilitate the creation and publication of professional content and interaction among users in an ethical and constructive environment.

Allowed content: technical articles, blogs, short posts, training materials, and participation in forums or chats.

Criteria: original, accurate, and professional content; avoid offensive or unlawful material; respect legal rights; prioritize quality and relevance.

Intellectual property: the author retains their rights but grants ZTalent a non-exclusive, royalty-free, worldwide license to host, reproduce, and display their content within the platform. Removal may be requested unless legally or technically prevented.

Editorial oversight: moderators may review, edit, or remove content that infringes these rules, acting proportionately and transparently. Repeated breaches may result in limitations or suspension.

Forums & chat: users must remain respectful; offensive, abusive, discriminatory, defamatory, or violent messages are prohibited. ZTalent may moderate, remove, block, and log discussions to ensure compliance.

The use of the forum is additionally governed by the Forum Legal Notice, which details the specific participation rules, moderation criteria, and user responsibilities.

Use of Zelenia: Access to Zelenia artificial intelligence to optimize job searches, suggest improvements to the profile, and analyze market trends; it allows generating personalized reports, automating recruitment processes, and receiving proactive recommendations.

Liability limitation for authors: each author is fully responsible for their content; content does not constitute professional, legal, or technical advice.

8. Job Offers

• Posting: include title, description, requirements, location, and approximate salary.
• Moderation & Duration: anti-fraud review; active for 30 days, renewable.
• Fees: basic posting is free; premium options for higher visibility are available.

9. Premium Services & Billing

• Subscriptions: monthly or annual plans, including unlimited access to Zelenia and exclusive discounts.
• Payment & VAT: by card or PayPal; prices include VAT.
• Expiry: credits expire 12 months after issue or at the end of the contracted period.

10. Cancellation, Withdrawal and Refund Policy

Credit Packs: the user may withdraw from the purchase within 14 calendar days from the confirmation, provided that the credits have not been used. In such case, a full refund will be issued. If there has been partial use, the refund will be proportional to the unused credits.

Subscriptions: subscriptions may be cancelled at any time, maintaining access until the end of the contracted period. If the withdrawal is exercised within 14 days from the subscription date and Zelenia or other Premium services have not been used, the corresponding amount will be refunded. The use of Zelenia or other personalized digital content implies the loss of the right of withdrawal, in accordance with Article 103 (m) of Royal Legislative Decree 1/2007.

Procedure: requests must be sent to info@ztalent.tech, indicating the order number and user details. ZTalent will confirm receipt and process the refund using the same payment method within a maximum period of 14 days.

11. Intermediation

ZTalent acts solely as a technology platform connecting SAP® professionals and companies and assumes no obligations or liabilities arising from contracts between them.

12. Intellectual Property and AI Feedback

All content published on ZTalent is the property of the Company or of authorized third parties, and is protected under the applicable intellectual property laws.

The use, reproduction, or distribution of such content without express authorization is strictly prohibited.

Ideas, suggestions, comments or any type of feedback relating to Zelenia or other artificial intelligence tools, voluntarily submitted by users, shall become the property of ZTalent. Such feedback may be used for improvement, development or innovation purposes, without generating any right to compensation, unless otherwise expressly agreed.

13. Responsibilities and Disclaimers

ZTalent provides the platform “as is”, without guaranteeing continuous availability or the absence of errors or interruptions.

ZTalent is not liable for direct or indirect damages, third-party content, or actions carried out by other users.

Each user is solely responsible for their own publications and for their use of the platform.

14. Data Protection and Cookies

The processing of personal data is carried out in accordance with the GDPR, the LOPDGDD, and other applicable regulations.

Users may exercise their rights of access, rectification, erasure, restriction, portability and objection by sending a request to info@ztalent.tech, and providing proof of identity.

ZTalent uses first-party and third-party cookies for technical, analytical and advertising purposes; the use of cookies requires express consent in accordance with the Cookie Policy.

15. Amendments

ZTalent may update these Terms at any time. The current version will be available at www.ztalent.tech, and continued use of the platform shall constitute express acceptance.

16. Governing Law and Jurisdiction

These Terms are governed by Spanish law. The Courts and Tribunals of Madrid shall have jurisdiction.

17. Scope of Use

ZTalent is designed for professional, commercial, and profit-oriented use. The use of automated data extraction tools (bots, spiders, scrapers or similar) is prohibited without authorization. ZTalent may restrict access to any user who violates these Terms or engages in unlawful or abusive use of the platform.

18. Ethical Conduct and Accuracy

Users must act with professional ethics and publish truthful and respectful information. ZTalent may suspend or delete accounts that violate these principles. The Company may verify compliance with these rules and act proportionally in response to conduct contrary to good faith or to the spirit of the platform.

19. Opinions and Comments

Comments and opinions posted by users do not represent the position of ZTalent.

Each user is solely responsible for the content they publish.

Offensive, discriminatory, defamatory, unlawful or rights-infringing content will not be permitted.

ZTalent may moderate, remove or block content that violates these rules, as well as restrict access to users who repeatedly infringe them.

20. External Links and Hyperlinks

ZTalent may contain links to third-party websites. The Company is not responsible for the content, accuracy, legality or functioning of such external sites.

Any person wishing to establish a hyperlink to ZTalent must obtain prior written authorization. ZTalent reserves the right to revoke such authorization at any time.

21. Service Suspension

ZTalent may temporarily suspend access to the platform without prior notice when maintenance, updates or service improvements are required. Such suspension shall not generate any liability for the Company, provided that it is carried out in accordance with applicable regulations.

23. Electronic Communications

The user consents to receive notifications and communications through electronic means (email, platform messages or alerts). This consent may be revoked by sending a request to info@ztalent.tech.

24. Professional Nature of the Service

ZTalent is primarily intended for professionals and companies within the SAP field. Consumer protection regulations (RDL 1/2007) will only apply when the user acts outside their professional or business activity.

25. Partial Invalidity

If any clause is declared null or unenforceable, this shall not affect the remaining Conditions, which will remain fully valid.

26. Alternative Dispute Resolution

In accordance with Regulation (EU) 524/2013, users are informed of the European Online Dispute Resolution Platform, available at https://ec.europa.eu/consumers/odr.

27. Entry into Force

These Conditions enter into force on November 3, 2025, and will remain in effect until amended or replaced.
